Judge overturns prenuptial agreement

In a recent English divorce case, a man has successfully challenged the prenuptial agreement that he signed with his wealthy wife, reports the Guardian.

Frankie Limata married Victoria Luckwell in 2005, and the couple had three children together. They separated in 2012.

According to the Guardian, Ms Luckwell is the daughter of millionaire Mike Luckwell, and owned the home the family lived in in London, which is worth around £6.7 million and was given to her by her father. Her husband had no assets, and has debts amounting to around £226,000.

The couple reportedly signed a prenuptial agreement at the start of the marriage, and also two subsequent agreements, which stated that Mr Limata would not make any claims against his wife’s assets.

However, the judge ruled that he should receive a settlement of around £1.2 million, which would allow him to pay off his debts and buy a house suitable for the couple’s children to stay in when they visited him. According to Ms Luckwell, she will have to sell off her home in order to provide this for her estranged husband, reports the Guardian.

Once the youngest child turns 22, the house bought by Mr Limata is to be sold, said the judge, with 45% of the proceeds going back to Ms Luckwell and the rest to be used by Mr Limata to buy himself a home for the rest of his life.
