Lawyers in the United States are reporting an increase in the number of couples requesting that social media clauses be included in their prenuptial agreements, reports ABC News.
The practice is particularly popular with professional couples, who want to prevent their partner from posting anything potentially embarrassing about them online that could damage their professional reputation.
These social media clauses will typically cover what is and is not acceptable to be posted online, and will usually also contain details of any financial penalties to be paid should the clause be breached. The size of this penalty apparently varies depending on the wealth of the couple, but ABC News reports that $50,000 per breach is quite common in New York.
“It’s a huge issue because we all know this stuff, once it’s out there, you can’t shake it,” explained Ann-Margaret Carrozza, a New York lawyer with experience in these clauses. “It can be humiliating. It can be painful. ... It’s really no joke, and I expect this clause to become much more important with any of the other contracts.”
