A court in Melbourne has overturned a prenuptial agreement that the wife had been pressured into signing, reports the Herald Sun.
She was presented with the agreement two days before her wedding by her husband-to-be, who said he would not go through with the wedding unless she signed it.
As her parents had paid a substantial amount for the wedding and she didn’t want to have to cancel, she agreed to sign it, even though she knew the terms were disadvantageous to her.
The agreement set out that in the event of divorce she would get to keep the assets she had at the time of the marriage, but would not be entitled to anything else. At the time of signing, her assets were relatively small, whereas her husband had significant assets that subsequently increased during the term of the marriage.
When the couple divorced, she was the primary carers of their two children and reliant on welfare and the judge ruled that the agreement should be set aside, reports the Herald Sun.
